have hosted a “first of it’s kind” virtual informal board meeting via Zoom on
April 23, 2020 at 7:00 p.m.<span style="mso-spacerun: yes;"> </span>The meeting
was also simultaneously live-streamed via Facebook.<span style="mso-spacerun: yes;"> </span>Eighty-eight (88) community members joined us
on Zoom and Facebook for the meeting, including our Windward Community
Legislators – Senator Jarrett Keohokalole, Representative Scot Matayoshi,
Representative Lisa Kitagawa and Council Chair Ikaika Anderson.<span style="mso-spacerun: yes;"> </span>In light of the ever-evolving changes taking
place in our community due to the COVID-19 pandemic, the Kaneohe NB feels it is
vital to continue our regular monthly meetings in order to keep our community
connected and informed. </div>

Depending on how long this type of environment exists, it's more important now to make sure neighborhood boards remain relevant and stay connected to their respective communities. Through formal letter, we are asking the Mayor of the City and County of Honolulu to permit official meetings of neighborhood boards that desire to operate temporarily in this environment.<br />

insight into officer-training of handling COVID-19 related incidents,

Center has opened a center for additional volunteers to assist with the backlog
– 420 volunteers are currently working throughout the day to process

since a claim has been filed, to file another claim.</b><span style="mso-spacerun: yes;"> </span>Next week, the Department will also be
opening up an additional call center to expand the amount of people taking

the current wait time community members are experiencing.</div>

Here is a synopsis of this month's meeting:<br />

1. Sam Malani volunteered to serve on the board for Kapunahala subdistrict 8. He was voted in unanimously - Welcome aboard Sam!<br />

During monthly reports, there is a pattern of questions relating to the ever-increasing "neighborhood" fireworks displays and people are genuinely concerned that rules effected are unenforceable or neighbors are not willing to identify other neighbors. Rep. Matayoshi is introducing legislation to hopefully aerial products at the ports of entry.<br />

3. State Hospital is looking at a color scheme that better fits the landscape.<br />

Federal Aviation Administration (FAA), Code of Federal Regulations (CFR) and
standard safety of flight procedures occurred and was captured on video, as a
passenger jumped from a hovering helicopter over the Kaneohe Bay sandbar without
regard for people below and/or depth of water; and</span></span><br />
<br />
<span style="font-family: "arial" , sans-serif;">WHEREAS,<span style="background: white;"> rapidly increasing and widespread operation of tour
helicopters and other small aircraft pose increased safety risks to communities
on the ground and have increasingly disrupted neighborhoods and lives throughout
O'ahu; and</span></span><br />
<br />
<span style="font-family: "arial" , sans-serif;">WHEREAS,<span style="background: white;"> there is minimal and open-ended regulation of tour
helicopter operations as well as small fixed-wing tour aircraft operations; and
</span></span><br />

<span style="font-family: "arial" , sans-serif;">WHEREAS,<span style="background: white;"> the claimed self-regulation by tour helicopter
operators has been proven ineffective and cannot be expected to improve, and
the present sequestered updating of the inadequate 2008 “Hawai‘i Air Tour Common
Procedures Manual” solely between tour helicopter operators and Hawai‘i Federal
Aviation Administration officials is insufficient; and</span></span><br />
<br />
<span style="font-family: "arial" , sans-serif;">WHEREAS,<span style="background: white;"> substantially increased government regulation of all
aspects of commercial and tour helicopter operations is now necessary to
address rapidly increasing safety risks in the air as well as on the ground;

For more information as their plan develops <a href="https://kaneoheneighborhoodboard.org/heco-windward-sustainability-project" target="_blank">click here</a>.Kaneohe Neighborhood Boardhttp://www.blogger.com/profile/04111729442990216682noreply@blogger.com0tag:blogger.com,1999:blog-1998528789186246786.post-14700151509023912702018-12-09T11:36:00.000-10:002018-12-09T11:36:33.648-10:00OPPOSING THE SPECIAL MANAGEMENT AREA USE PERMIT FOR THE DEVELOPMENT BY CHARLES TSU YEW WONG AT 46-107 LILIPUNA ROAD – KANEOHEOPPOSING THE SPECIAL MANAGEMENT AREA USE PERMIT FOR THE DEVELOPMENT BY CHARLES TSU YEW WONG AT 46-107 LILIPUNA ROAD – KANEOHE, TAX MAP KEY 4-6-001:007.<br /><br />WHEREAS, the Revised Ordinances of Honolulu, Chapter 25, Section 25-3.2 (a) (4) Special Management Area review guidelines States: Alterations to existing land forms and vegetation, except crops, and construction of structures shall cause minimum adverse effect to water resources and scenic and recreational amenities and minimum danger of flood, landslides, erosion, siltation or failure in the event of earthquake.<br /><br />WHEREAS, the original dwelling at that location was a small beach cottage, and now there are two structures that are three stories high and one that is two stories high, totaling 7,611 SF with 10 parking stalls, a pool, a basement and a deck extension for the pool all built on adobe clay soil near the shoreline for a single resident; and<br /><br />WHEREAS, this new development was built in large part either without permits or without following approved plans that were permitted, or at best with permits obtained after construction; and<br /><br />WHEREAS, without a permit, Mr. Wong removed a mangrove 50’ wide and 150’ long “to make way for the basement”. After the fact, he says that he received permission to remove the mangrove from DLNR under an “Emergency Clean Up Order”. But, there was no emergency; and<br /><br />WHEREAS, there is an unresolved Notice of Violation dated Nov. 18, 2014 for not following the permitted plans and requiring the verification survey of the location of new rock masonry walls, heights & setbacks for front, side yard spacing along with 55 feet shoreline set back. The survey is also to show grade changes, along with new envelope heights for the dwelling structure. And States that If a building permit cannot be obtained, the walls and the alterations must be removed and restored to its approved State and orders Mr. Wong to take immediate measures to stabilize the site and protect abutting properties; and<br /><br />WHEREAS, this development is in a Special Management Area and these set back requirements need to be adhered to in order to protect the shorelines; and<br /><br />WHEREAS, the change in grade made to Mr. Wong’s property, keeps storm water runoff from reaching the bay via his property. This increases the run-off load onto his neighbors’ properties; and<br /><br />WHEREAS, Mr. Wong dug down 13 feet on his property and built a basement and an endless pool and a pool deck without permits; and<br /><br />WHEREAS, there is an unresolved Notice of Violation dated May 12, 2014 for the added basement, the new deck and for alterations to the structure at the front of the property that were not being done in accordance with the approved plan; and<br /><br />WHEREAS civil fines for these unresolved violations are currently in excess of $400,00 is evidence of Mr. Wong’s inability or unwillingness to bring his project into compliance; and<br /><br />WHEREAS permitting this type of development in this Special Management Area would set a precedent that would multiply these adverse effects to water resources and increase the danger of flood, landslides, erosion, siltation or possibly failure in the event of earthquake.<br /><br />BE IT RESOLVED by the Kaneohe Neighborhood Board that the Special Management Area Use Permit be denied.<br /><br />BE IT FURTHER RESOLVED that the Director of Planning and Permitting enforce the orders as Stated on the May 12, 2014 Notice of Violation and proceed as Stated, to have the required work done by the City and the cost thereof charged to the owner.<br />BE IT FURTHER RESOLVED that the Director of Planning and Permitting enforce the orders as Stated on the November 18, 2014 Notice of Violation and proceed as Stated, to refer the matter to the Prosecuting Attorney and/or Corporation Council for appropriate action.<br /><br />BE IT FINALLY RESOLVED that this resolution and the copies of the Notices of Violation attached hereto, be delivered on or before October 22, 2018 as testimony at the Public Hearing on October 23, 2018 regarding 2018/SMA-45(AB) application for a Special Management Area Use Permit by Charles Tsu Yew Wong property at Tax Map Key 4-6-001:007 to the Department of Planning and Permitting to the attention of Alex Beatty, Staff Member and Kathy Sokugawa, Acting Director and Timothy Hiu, Deputy Director and Eugene Takahashi, Deputy Director as well as to all members of the Council of the City and County of Honolulu.Kaneohe Neighborhood Boardhttp://www.blogger.com/profile/04111729442990216682noreply@blogger.com0tag:blogger.com,1999:blog-1998528789186246786.post-87027731901124338942018-12-09T11:11:00.000-10:002018-12-09T11:11:23.517-10:00Mayor Kirk Caldwell’s Report October 2018Mayor Kirk Caldwell’s Representative – Director Lori Kahikina reported the following:<br />• Old Kaneohe Bay Drive: In response to concerns with potholes along Kaneohe Bay Drive, the Department of Facility Maintenance (DFM) responded that the issue is under the jurisdiction of the State Department of Transportation (HDOT). The issue was transmitted to HDOT.<br />• Traffic Calming: In response to requests for traffic calming along certain portions of Haiku Road, a DTS study concluded that traffic calming is not warranted. DTS recommended that the removal of restricted parking might assist in the issues that generated the traffic calming requests.<br />• Pua Alowalo: In response to concerns with traffic and pedestrian risks at Pua Alowalo, DTS responded that more time is needed to conduct necessary studies. Director Kahikina added that she requested DTS to attend the next meeting to discuss the concerns with affected residents.<br /><br />Questions, comments, and concerns followed:<br />1. Pahia Crosswalk: Chair Radke asked and Director Kahikina responded that she will provide an update related to Pahia crosswalk at another time.<br />2. Kaneohe Christmas Parade Path: A resident and representative from the Kaneohe Christmas Parade requested that the dip in the road on Kamehameha Highway near the Fire Station be repaired prior to the Saturday, December 1, 2018 parade. In addition she requested the Haiku Road Wastewater project be completed by then or at least impacts to the parade be mitigated.<br />3. Old Kaneohe Bay Drive: Vice Chair Sager expressed concerns with the dilapidated condition of Old Kaneohe Bay Drive due to the potholes, specifically between Mikiola Drive and MCBH. He asked if the dilapidated condition would require a complete replacement of the road. Transportation Committee Chair Sevier commented that it may be postponed pending a Complete Streets analysis of the area.<br />4. <br />• Online Board Member Training: NCO has developed an online training program for neighborhood board members to improve their understanding of the Neighborhood Plan, Sunshine Law, and Robert’s Rules of Order. All training exercises are posted on the NCO website.<br />
<br />• Social Media: NCO is in the process of posting promotional videos, public service announcements, and follow-up videos where the effectiveness of requests made at neighborhood board meetings will be demonstrated. Well we had our October meeting last night. The picture above is a list of requested donation items by RYSE Hawaii. If you aren't familiar with RYSE they are a shelter for the young homeless population, between 18 and 24. At our last meeting they were asked to for items that they could use so they created a donation list. Their number is listed on the bottom as well. Just in case the list isn't readable I will give you it typed out in this post as well:<br />

The rest of the night was productive. Both HSTA and the Affordable Hawaii Coalition PAC had people present their perspectives on the Constitutional Amendment which would grant the state legislature the ability to tax investment properties for education. There was a lot of heated debate. </div>

HSTA's official, Micah Pregitzer, spoke about how just with raw math currently the budget for education provides about $11,000 per student and that with building upkeep and maintenance that it doesn't go very far. He also talked about how we have a teacher shortage and many classes have to rotate substitutes as well as pointing out that we are the only state to not have an education property tax</div>

Hawaii Coalition PAC's rep, Stanley Lau, spoke to a lot of fears surrounding the bill on what the definition of investment property will be and that we shouldn't be granting the legislature a power like this. He referenced the hotel tax, which was originally done to build the convention center and is still there even though the convention center is built.</div>

It was obvious that the room is divided on this issue so we will have to see what the community wants once it goes to the polls.</div>

For board business the board passed a resolution against the Wong Residence which will be presented as our opposition to them being able to get a permit for the illegal work they have done on their property. This has been an area of frustration and anger in our community so we will see if our local government decides to give the resolution some teeth.</div>

On happier notes a new member was elected to the board, Trenton Oshiro, who we welcome and look forward to working with.</div>

Our committee for the Hawaii Memorial Park Expansion reported back on their meeting. They stated that the developers have done more work than most developers they have encountered to address the community concerns with the plan and to mitigate potential impacts. There were still many community members unhappy with the plan. It was unclear based on the discussion if there will ever be a plan that some members are ok with. On one hand the committee said they addressed all the previous concerns and then on the other some community members still are not happy. I don't know if there will be a resolution that everyone can live with, but we will continue the conversation and see. The board chose not to take a side on this issue yet, but is reporting it's findings to relevant officials.</div>

The neighborhood board committee reminded us that there will be board elections in the next coming year. December through February will be the time to register. In March profiles online profiles will be created. April through May will be the time for voting. In June the tabulation will occur with the new board taking over in July.</div>

We had quite a few people bring up important issues at last months meeting and in response our chair has created a flow chart to view how the normal process of getting a resolution through the neighborhood board goes. To be clear anyone in the community is free to draft a resolution you just need to get a board member to introduce it.<br />

You'll see at the top once an issue is brought to the board their is a discussion and then there are two routes to getting a resolution for the board to take action on.<br />
<br />
In the first route the committee takes this issue up and has a normal committee meeting open to the public and then drafts a resolution which is then presented to the board for a action. If you take this route a resolution can come into being in 2 normal board meetings ( 1 for introduction of issue, 2nd for the board action) and a committee meeting happens in-between the two.<br />
<br />
The other option is the board can vote to form a Personal Interaction Group (PIG). If using a PIG then the PIG members can form meetings and have communication over the issue whenever they want and then they must report all findings and recommendation of actions to the board at a normal board meeting. This route takes a little longer to accomplish, because the 1st meeting the issue is brought to the board, the 2nd meeting the board votes to approve the PIG and then the 3rd regular meeting the PIG can present it's findings and resolution. <br />

We had multiple issues brought up last meeting and we have multiple issues we will be discussing this month as well as resolutions for various items that will be voted on. Also people from both sides of the Constitutional Amendment debate will be presenting and leaving room for questions. Another month and another meeting. Last night there was many good community concerns brought up. Sherri Thomas with Hawaiiana Property Management shared about bulk pickup trash concern where people from outside of her community had been coming and leaving bulk trash items on their curbs completely obstructing their sidewalk. She mentioned witnessing one child, who was skateboarding, trying to go around this and almost being hit by a car. This is a huge safety concern, and one that is not unique to anyones neighborhood. This is an opportunity for us as a community to start organizing and determining actionable solutions. Ideas and action plans are welcome.<div>

Mitch Rosen, a member of the board of Directors of Haiku Gardens, brought up another safety concern in regards to the exit of the the parking lot of one of the complexes to Haiku Rd. Mr. Rosen provided pictures to show that the way Haiku Rd curves at this exit, coupled with the parking on the street as well as a large telephone pole that blocks visibility to oncoming traffic makes coming out extremely difficult. Residents have reported that cars tend to speed up on this street so this couples the complexity of the safety hazard. Given that this is a complex with up to 200 vehicles entering and leaving every day the community would like to see some form of solution to address this. Suggestions have been speed bumps before this driveway to slow oncoming traffic, concave mirrors opposite the driveway to help ensure visibility, and pushing back the parking in front of these driveways so as to unobstruct the view. Mr. Rosen also mentioned that the board has been 3rd of 4th stop to try to get some action on this item. The board will have our committee member responsible for the transportation and a representative of this community try to reach out to her contacts about what options are possible, and then next meeting we will discuss about putting together and action group of some form with the intent of hopefully writing a resolution. </div>

On some positive news the board was thrilled to be able to give out an award to acknowledge the hard work of Bill Dixon who in the past has done exceptional work on his community outreach for the Kaneohe Neighborhood Board by really rejuvenating our blog and aiding us in getting information to residents before minutes went through the process of being approved and published. </div>

Next month will be an exciting meeting. We have representatives on both sides of the issue of the Constitutional Amendment on taxing investment properties to bring in more money for schools coming to speak to the board and the community on their stances. Please think of attending to get the information on this important question being asked this coming election. The next meeting will be October 18th at 7PM in our usual location, the cafeteria of Ben Parker Elementary School. Also there is a scheduled community planning meeting for Hawaii Memorial Park which will be held on October 3rd, 7PM at the Ko'olaupoko Hawaiian Civic Club (46-005 Kawa St. #104, Kaneohe, HI 96744).
